Legal notices and disclaimers governing use of EstateSelect. Please read carefully before posting listings, making payments, or contacting listers.

1. Acceptance of terms

These Terms of Use ("Terms") govern access to and use of the EstateSelect website and related services at estateselect.in (the "Platform"), operated by EstateSelect ("we", "us", "our").

By accessing, browsing, registering, posting a listing, making a payment, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

If you use the Platform on behalf of another person or entity, you represent that you have authority to bind that party to these Terms.

2. Platform role — advertising intermediary only

EstateSelect is an online advertising and discovery platform. We display property-related listings submitted by owners, landlords, realtors, and other users.

We are not a landlord, tenant, property manager, real estate broker, RERA-registered agent, or party to any lease, licence, PG agreement, or roommate arrangement unless explicitly stated in writing.

We do not guarantee the availability, condition, legal title, safety, or suitability of any property. All negotiations, site visits, documentation, deposits, and rental agreements are solely between listing parties.

Realtor or agent listings may involve separate commission or brokerage terms between you and the lister — we do not set or collect such commissions unless clearly disclosed on the Platform.

3. Listings and user content

Listers are solely responsible for the accuracy, completeness, legality, and timeliness of listing content including photographs, rent amounts, location, availability, and contact details.

You must not post misleading, fraudulent, discriminatory, infringing, or unlawful content. You represent that you have the right to advertise the property and to share contact information provided.

We may review, edit, refuse, suspend, or remove listings at our discretion without notice. Removal does not entitle you to a refund except as stated in these Terms or applicable law.

By submitting content, you grant us a non-exclusive, royalty-free licence to display, reproduce, and promote that content on the Platform and in related marketing.

4. Tenant browsing and contact unlock

Tenants and seekers may browse public listing information subject to these Terms. Access to owner or lister contact details may require sign-in and payment of a tenant access fee where applicable.

Contact details are provided for legitimate rental inquiry purposes only. Misuse, spam, harassment, or automated scraping is prohibited.

Always verify identity, inspect properties in person, and conduct independent due diligence before paying deposits or signing agreements. We are not responsible for offline interactions between users.

5. Fees and payments

Listing publication fees and tenant access fees (if any) are displayed on the Platform before payment. Fees are generally non-refundable once the related service is delivered, except where required by applicable law or explicitly stated.

Payments are processed through third-party payment providers (e.g. Razorpay). We do not store full payment card credentials. Your use of payment services is also subject to the provider's terms.

Promotional pricing, discounts, or admin fee waivers may be offered at our discretion and may be modified or withdrawn at any time.

Failure to pay applicable listing fees may keep a listing hidden from public search until payment is completed or an admin override is applied.

6. Privacy and data

We collect and process personal data necessary to operate the Platform — including account information (via Google sign-in), listing details, contact information, payment records, and usage logs.

Data is used to provide services, process payments, send service-related communications (e.g. listing alerts, verification reminders), prevent fraud, and improve the Platform.

We may share data with service providers (hosting, email, payments, image hosting) under appropriate safeguards. We do not sell personal data.

For privacy-related requests, contact propmanager@estateselect.in. Our practices are intended to align with applicable Indian law including the Digital Personal Data Protection Act, 2023, as implemented.

7. Prohibited conduct

You must not: (a) violate any applicable law; (b) impersonate others or provide false information; (c) post duplicate or fake listings; (d) circumvent paywalls or access controls; (e) scrape, crawl, or harvest data without permission; (f) transmit malware or interfere with Platform security; (g) harass other users; or (h) use the Platform for unlawful discrimination.

We may suspend or terminate accounts and report activity to authorities where appropriate.

8. Disclaimer of warranties

THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted, error-free, or secure operation, or that listings are accurate, current, or free from harmful components.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESTATESELECT, ITS OWNERS, PROMOTERS, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

Our aggregate liability for any claim arising out of or relating to the Platform or these Terms shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) INR 5,000.

Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless EstateSelect, its owners, promoters, partners, directors, officers, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your listings or user content; (c) your breach of these Terms; (d) your violation of any law or third-party rights; or (e) any dispute between you and another user.

We may assume exclusive defence of any matter subject to indemnification; you will cooperate with us at your expense.

11. Intellectual property

EstateSelect name, logos, and Platform design elements are our property or our licensors' property. You may not use our marks without prior written consent.

Third-party trademarks and content remain the property of their respective owners.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including for breach of these Terms.

Upon termination, provisions that by nature should survive (including disclaimers, limitation of liability, and indemnification) will survive.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, courts in Maharashtra, India shall have exclusive jurisdiction over disputes arising from these Terms or the Platform.

You agree to attempt good-faith resolution of disputes by contacting us before initiating formal proceedings where reasonable.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect changes. Continued use after changes constitutes acceptance of the revised Terms.

Material changes may also be communicated via the Platform or email where appropriate.
